These Terms of Service ("Terms") govern your use of the Engulfy website at engulfy.com and all related services (the "Service"), operated by Fresh Software LLC, a Wisconsin limited liability company. By accessing or using the Service, you agree to be bound by these Terms.

1. Eligibility

You must be at least 18 years old to use the Service. By creating an account, you represent that you meet this requirement and that the information you provide is accurate and complete.

2. Account Responsibilities

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to notify us immediately at helpdesk@engulfy.com if you suspect unauthorized access.

3. Description of Service

Engulfy provides market-data alerts for informational purposes only. Alerts may include candlestick pattern updates, indicator signals, and other market data delivered via email, SMS, or MMS based on your subscriptions. Engulfy does not provide investment, financial, tax, or legal advice. You should consult a qualified professional before making any investment decisions.

4. SMS / Text Messaging Terms

If you opt in to receive SMS or MMS messages from Engulfy:

• You consent to receive recurring automated text messages related to the market tickers you subscribe to.
• Message frequency varies based on your selected subscriptions.
• Message and data rates may apply.
• You may opt out at any time by replying STOP. Reply HELP for assistance.
• SMS consent and your mobile number are not shared with third parties or affiliates for marketing or promotional purposes. See our Privacy Policy for full details.

5. Subscriptions and Billing

Certain features of the Service require a paid subscription. Payments are processed by Stripe. By subscribing, you authorize recurring charges in accordance with the plan you select. You may cancel your subscription at any time from your account dashboard. Refund eligibility is determined on a case-by-case basis.

6. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose.
• Attempt to interfere with or disrupt the Service or its infrastructure.
• Scrape, crawl, or use automated means to access the Service without our written consent.
• Resell or redistribute alerts or data obtained from the Service.

7. Intellectual Property

All content, branding, and software associated with Engulfy are the property of Fresh Software LLC. You may not copy, modify, or distribute any part of the Service without our prior written consent. Market data provided through the Service is sourced from third-party providers and is subject to their respective terms.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THE ACCURACY, COMPLETENESS, OR TIMELINESS OF ANY MARKET DATA OR ALERTS. SERVICE AVAILABILITY AND MESSAGE DELIVERY ARE NOT GUARANTEED.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, FRESH SOFTWARE LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR INVESTMENT LOSSES, ARISING OUT OF YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

10. Termination

We reserve the right to suspend or terminate your account at our discretion if you violate these Terms. You may close your account at any time by contacting helpdesk@engulfy.com. Upon termination, your right to use the Service ceases immediately.

11. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will update the "Last Updated" date at the top of this page. Continued use of the Service after changes constitutes acceptance of the revised Terms.

12. Governing Law

These Terms are governed by the laws of the State of Wisconsin, United States, without regard to conflict-of-law principles. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Eau Claire County, Wisconsin.
